There have also been defenses raised in recent years questioning the accuracy of the testing devices used by police. There also are some opportunities to bring up defenses related to the handling of evidence after it was tested, in the case of blood or urine samples being used to prove that you were over the legal limit.
The second "road" that we can take is to work with the prosecution to try to make an agreement. For example, there have been cases in the past where DUI charges are dropped and the driver instead agrees to a reckless driving or similar charge. While it is still a moving offense, and it still may have an effect on your insurance premium, the consequences are far less severe than if you are convicted of DUI.
Felony DUI Charges
While the consequences can still be severe, most DUI charges are misdemeanor charges. However, there are cases, due to either repeat DUI violations or other aggravating factors, where a DUI can cause a felony charge. Typically if you have two prior DUI convictions the third DUI will be charged as a felony. Other aggravating factors that can cause even a first DUI arrest to be charged as a felony include:
- Driving a school bus with minor (under 18 years of age) passengers
- Being involved in an accident resulting in bodily harm of another person, reglardless of who was at fault for the accident
- Being arrested in a School Zone
- Being arrested for a DUI while using a suspended or revoked license
- Being arrested for DUI without automobile insurance
